A DRUNKEN man fell off his bike into the road and then swore at members of the public who tried to come to his aid, a court has heard.

Elliott Phipps, 26, of Mather Drive in Comberbach, pleaded guilty to a charge of being drink and disorderly in a public place, when he appeared before magistrates in Chester on Wednesday (August 26).

Alan Currums, prosecuting, told the bench how Phipps had been riding along Winnington Lane in Northwich, shortly before 9am on July 17 this year, when he came off the bike and fell into the road.

He said: "Police were called after Phipps became abusive to members of the public.

"When they arrived at the scene Phipps, who had blood on his face from the impact of the fall, was swearing at people.

"It was early in the morning and there were several children around on their way to school."

Phipps, who has previously served a custodial sentence for committing an act of outraging public decency, was heard shouting, "I'm not f***ing swearing, you're taking the p**s" and continued to swear as officers tried their best to calm him down.

Richard Sibeon, defending, said it was unusual to have an incident of drunk and disorderly so early in the morning and that Phipps had clearly had a heavy night of drinking.

Mr Sibeon said:"He doesn't have too much recollection of what actually happened.

"He tells me he was on his way to McDonalds at the time he came off the bike, so that maybe would have helped soak up some of the alcohol.

"It's a low level offence and after being released from prison, he had completed his license without any bother."

Magistrates fined Phipps £40 and he must also pay costs of £80 and a surcharge of £34.
