THE case against a Northwich man charged with making threats to kill police officers has been closed.

Police spent 11 days searching the Carlton Road home of 58-year-old Trevor Daniels but the prosecution offered no evidence when he appeared at Chester Crown Court on March 1.

He had been arrested in February and charged with two counts of threatening to kill police officers and one count of resisting arrest.

Ursula Doyle, district crown prosecutor with Mersey-Cheshire Crown Prosecution Service (CPS), said: "A file of evidence was received by the CPS from Cheshire Police about alleged threats issued by Trevor Daniels.

"He had been charged with the offence of threats to kill.

"The CPS is responsible for deciding whether or not the charge should be prosecuted.

"The case was reviewed in accordance with the Code for Crown Prosecutors.

"After much thought and consideration, it was decided that, due to the circumstances in which Mr Daniels voiced the alleged threats, there was insufficient evidence to prove the criminal offence of making a threat to kill.

"In particular the prosecution could not prove that Mr Daniels had acted with the required intention.

"The CPS stopped the case. Any decision by the CPS does not imply any finding concerning guilt or criminal conduct; the CPS makes decisions only according to the test set out in the Code for Crown Prosecutors and it is applied in all decisions on whether or not to prosecute.

"Extensive searches were made of Mr Daniels’ home by Cheshire Police following the allegations of making a threat to kill.

"The police did not pursue any action following those searches and no file of evidence was brought to the CPS in relation to anything found at the premises.

"The CPS has provided a full explanation to the complainant in writing.

"The complainant has been advised of their right to have the case reviewed."
