STRICT conditions are to be applied over construction times and the delivery of materials at a housing development in Rudheath.

The conditions relate to a scheme for nine houses at School Road North, which has received the green light from Cheshire West and Chester Council.

The scheme submitted by Mr V Houlston from Davenham is to be known as Canal Walk, and has received outline planning approval subject to a number of conditions.

The A556 lies to the south of the site, the canal to the east and Rudheath Primary Academy to the west, with housing to the north of the canal.

To protect people living nearby from disturbance no construction, deliveries or other operations can be undertaken on any phase of the development before 8am and after 6pm Monday to Friday, and before 8am and after 1pm on a Saturday.

No works will be allowed on Sundays or Bank Holidays without the permission of the council.

No construction, demolition or excavation works can be carried out on the site between March 1 and August 31 unless the site is surveyed for breeding birds and a scheme to protect such birds is submitted to and approved by the council.

In addition no development will be allowed until a scheme specifying mitigation measures to comply with noise limits has been submitted to and approved by the council.

The scheme which was approved represents a reduction of five houses on original plans for 14 properties.

Mr and Mrs Houlston wrote to Cheshire West and Chester Council in October about the development.

“The business which is currently based at School Road North has outgrown the space available there, and has proceeded to relocate to an industrial estate locally to continue trading,” they said.

“Therefore, there is no need to consider that the application will mean the removal of employment, as the business had outgrown the site already.”

Council planning officers said the amended layout was more in keeping with the surrounding homes on the northern side of the canal, and the development was not considered unduly detrimental to the amenity of neighbouring residents.
