MILNGAVIE Community Council members have appointed the immediate past

president of the Law Society of Scotland, Mr Brian Adair, to advise them

on their legal defence against a development company which wants to

redevelop Dougalston golf course and build 100 houses in a green-belt

site.

Co-ordinated Land and Estates plc has served collective and individual

interim interdicts on the community council to prevent members from

issuing further leaflets which the company says contain ''false and

misleading'' statements about its development plans.

The council has until next Wednesday to lodge defences against the

interim interdict. Members also have received individual letters from

CLE's solicitors warning them that they may be liable to pay damages

arising from any losses suffered by the company as a result of ''the

distribution of inaccurate information and the suggestion that they are

acting in an irresponsible manner''.

A spokesman for the council said yesterday: ''The Milngavie Community

Council wished to defend against the interdict but has concern about the

implications, both legal and financial, and has asked a local solicitor,

Brian Adair, the immediate past president of the Law Society, to look

into these aspects and advise accordingly.''

CLE, based in London, bought the land on the outskirts of Glasgow from

Stakis which put forward similar development proposals in 1986 and 1990,

but abandoned them after furious opposition.

CLE's #6m scheme involves a nine-hole extension to the course, a new

clubhouse and other facilities, and the construction of 100 houses.

Local residents have lodged a large number of objections to the

proposals.
